Tumblys Art TOS

General Terms :

Commissions for regular art pieces (ie, not Vtuber/Live2D models) are for personal use only, I do offer commercial rights for designs, but this must be discussed with me personally beforehand. This means unless we explicitly come to an agreement, the rights to all artwork produced by me (Tumbly, TumblysArt, Lexy) is retained by me.Vtuber and Live2d models can be used for commercial works. Whatever is produced with them, as long as I am credited, is fine to be monetized. If you choose to sell any prints, tshirts, or items that have a model I created on them, please get permission from me prior so we can discuss crediting.By working with me you consent to anything produced by me to be used on my social media and portfolios to be used as examples of my work. If asked I will abide by debut dates for Vtuber models / commercial works. You agree to not trace, print, resell, or claim ownership over my work. Do not make major edits to my work without communicating this to me. You agree to not use or copy fragments, details, pieces of model art or rigging from project files for separate projects. You agree to not use my art for any AI related learning, or NFT/AI projects.

Payment Terms :

Payments are accepted via Paypal, Ko-Fi, and Cashapp, prices are listed in USD - though payment through other currencies is permissible as long as the conversions line up via Paypal.50% is taken up front before any progress is made on the commission. If your waitlist slot is more than 1 month out, I will ask for this to be paid before your slot is finalized, the week before the month of your commission is the final date for this payment to keep your slot. I was previously more flexible about this, however due to commissioners dropping out and financial stress this has become necessary. This is nonrefundable. I will not collect the second half until the full artwork is completed. If you choose to cancel your commission before its halfway mark (once work has been started on the actual model artwork itself) you can walk away at no extra cost. However if I am past that point and already have everything shaded, or into rigging, I may ask for up to 75%-80% of the remaining balance to be paid. * If you are afraid you may need to cancel please speak to me before you get to that point, I can hold off on making any additional progress.* The only exception to the original 50% being nonrefundable is if I cancel the commission due to an issue on my end. This would only occur under extreme circumstances, for example if my drawing tablet were to break.I can hold a commission for up to 1 week after completion if an emergency arises where you cannot pay your second payment. This can be extended to 1.5 weeks if the commission is completed earlier than predicted.I try to be flexible, but after the designated time if it is not paid I may :
• Sell the model with redesign to recuperate the value of my time
• Sell pieces of your expressions
* I prefer NOT to do this. Please don’t make me.If you were on a waitlist for more than 2.5 weeks and feel you will be unable to pay your remaining 50%, I can move you back on the list 2 times. If by the 3rd time you are still not ready I will remove you from my waitlist until you are able to sort out whatever the payment issue may be.

Commissioning Process :

Models take on average around 1-2 weeks to complete from the start of my waitlistYou can provide any references. I can work off of general descriptions, moodboards, a collection of images of other characters for reference, full ref sheets, doodles, anything of the sort.* If references are very vague and I need to help you design, a $50 design fee may be tacked on. I will let you know during your quote if I think this may be needed.I may ask questions to ensure I get any unclear details correct. I’ll try my best to fill in the gaps if you have rather ambiguous references.I will (if possible) update you in advance if there is a waitlist that you are coming up on, sometimes projects finish quicker than expected, but for the most part you will get a heads up beforehand.Once you’re at the front of my waitlist, you pay your 50% up front, and I begin working on your sketch. Usually within 24 hours I will produce a sketch of your character. If working with ambiguous/less detailed references I may provide a colored sketch if I think it's needed to pinpoint ideas.Once the sketch is approved I move onto creating the actual model pieces, this process can take a few days. As I make progress through the face, the body, and the clothing, I’ll continue to send WIP (work in progress) images so you can correct any missing or incorrect details during that time.Once all the pieces are completed I’ll send a finished image of the model unshaded to get your final opinion. If all is approved I move onto shading which may take another couple days.I will again show you the model for one last approval with all the art completely done. Once approved, the model will be moved into Live2d for rigging.I will send various WIPs through the rigging stages. You can give me any critique you may see necessary. This stage may take a few days, to one week depending on complexity.
Certain Features of models may utilize rig templates created by me, available, and used only by myself. This is reserved for complex rig features like Vbridger Mouths - these are of course edited to fit the model accordingly and do not impact the visual originality of your rig or project. It is only to ensure higher quality consistency. This also only applies to commissions where I am the artist.
Once all rigging is complete, I will request the second payment. Once the second payment is received, I will send over the model packaged in a ZIP form, along with any necessary files and an explanation on how to obtain the software and set up your model.

I reserve the full right to refuse continuation of service at any point, with appropriate partial/full reimbursement (based on work completed) OR partial reimbursement + work completed. Live2d files are almost never distributed or available in this case. PSDs, PNGs, Non-model live2d files may be provided. -- This is generally reserved for commissioners with continuous poor conduct.

By Commissioning Me, You Agree To These Terms.
These terms may change at any time if deemed necessary.

Payment Plan Info

For models created after my Fall 2023 Commission block, I do offer payment plans.
The total amount must be paid before the model files can be received.
Payment plans must be completed within 1 month after the start of your models production if the commission total is under $600.Payment plans can also be paid bi weekly if needed to align with payment schedules, just let me know when you generally get paid and we can work around that as well. Be advised, Bi - weekly payment plans follow the same 1 month restriction as weekly payment plans unless the $600 threshold is met.If you are on my waitlist, you may choose to start your payments before your model progress has started. You can pay over x amount of weeks / months my waitlist may be, plus the one month I give after the commission progress has started to allow for smaller payments per week. You can schedule specific weeks with me, so if you want extra time to pay it off by having me start later, don't be afraid to ask about my future availabilities rather than soonest. If a model is over $600, we can discuss a payment plan that will work for you specifically, however do be aware I prefer minimum payments of $100 per week. Anything lower may be hard for me to work with.

Model Information

Are you willing to make models that are xxx?

No Limits with species : furries, humans, anthros,
MLP characters, animals, mech, inanimate objects all welcome.
No Limits with Gender (Sex / Expression)No Limits with body typeGraphic Content (NSFW, GORE) OK ✓There is very few things I won't do ! Obviously, stuff such as NSFW models / suggestive themes depicting or involving minors (loli) are things I will NOT do.Feel free to inquire if you are unsure if I would be comfortable working on your project, or if it is unclear from this little example list.

What is the average turn around?

Average turn around time is between a couple of days, to around a week from the start date of your commission. I work rather quickly.I also take rush commissions, though because of the work load of two models in one week / potential to fall behind - the cost attached to this varies by my current workload.
Feel free to inquire.

What do I receive?

I provide the Zip file containing the actual model itself, as well as its expression files, and a preconfigured .vtube.json file if requested (pre-setting up expression keybinds and linking extra params like lean and Vbridger) .I no longer include the CMO3 or PSD as of May 2024 due to an art-theft related issue. I will hold onto models in a google drive, as well as keep them on a local drive if they ever need to be reexported, revised, or added onto.

What parameters should I expect?

The model comes with x, y, z capabilities, expressive eyebrow rigging (Sad, surprised, confused, neutral, angry keyforms)Eyes with the ability to be neutral, widened, have happy, angry, and sad forms linked to tracked expressionstep physics, if possible, 3d effects for shoes / legsphysics for all items such as ears, tails, clothing, breasts, arms, fingers, hair, anything that may require it or is requested by the commissioner.Expressive mouth rigging for webcam, with 15 keyforms.Tongue out, mouth X as courtesy for those who do not have vbridger.

Essentially anything necessary is covered, along with some extra stuff to make the models more expressive or flow nicer.I don't offer any different rigging packages nor do I limit / not offer certain parameters. All models get the same amount of "effort" / detail when it comes to their rigging regardless of cost. There are very few parameters I don't use with Live2d, and usually its because I like to make my own and link them through physics.

Have a question that wasnt answered here? Let me know and I can add it to this list to help future commissioners !
